Description of content and objectives

With EU Directive 2018/852, Europe has set more stringent waste recycling targets than in the past.

Specifically, it has established that by 31 December 2025, at least 65% by weight of all packaging waste must be recycled, with this percentage rising to 70% by 31 December 2030.

For some years now, the Union has prioritised the transition to a circular economy, and increasing the recycling of packaging waste is essential to achieving this goal.

However, there are still significant differences between Member States, and some countries have yet to implement the necessary waste management infrastructure.

Countries have also taken different approaches to transposing the directive.

The necessary consumer information, which should lead to the achievement of the set recycling targets and which saw the introduction of so-called "environmental labelling" in Italy, has not been provided for in the same way by all Member States; in some cases, no information tools have been introduced or made mandatory.

Regarding France, the AGEC law (Anti-waste for a circular economy law) of 10 February 2020 has recently been followed by the publication of numerous decrees. These have a direct impact on the activities of companies that produce or place products intended for consumption (electrical and electronic equipment, textiles, etc.) on the French market, including household packaging, in response to the requirements of the European directive.

The AGEC law creates various Extended Producer Responsibility (EPR) schemes, which are special mechanisms for organising waste prevention and management for certain types of products, and which create various obligations for producers of products subject to extended producer responsibility.

Extended producer responsibility for household packaging involves all companies that place packaged products consumed or used by households (i.e., the end consumer) on the French market and implies their responsibility for the management of household packaging, particularly its collection and recycling.

The webinar organised by Confindustria Varese aims to clarify certain aspects of this sector, namely the producers and products subject to the regulations, the various obligations incumbent upon producers, their entry into force, and any penalties for non-compliance, including the recent obligation to affix the TRIMAN logo, the INFO-TRI information and related instructions.

The topic will be addressed by Lawyer Maximilien Gaslini of the law firm Gaslini & Associés, with offices in Paris and Milan.

Mr Gaslini will provide an update on current obligations, the rules for subjection, and exemptions under this legislation, which particularly concerns those placing products intended for consumption on the market.
