Description of content and objectives

This meeting aims to examine and clarify the constantly evolving regulatory framework for public procurement. The subject of public contracts and the rules governing their award are subject to continuous revision by the legislature, and are also heavily influenced by rulings from European and national administrative courts, as well as interventions by the National Anti-Corruption Authority. Consequently, businesses must keep themselves constantly updated to navigate the public procurement market, remaining aware of both the complexities arising from legislative output and the opportunities that emerge.
A significant portion of the meeting will be dedicated to questions from participants, which may cover any topics related to public procurement, not limited to those addressed in the presentations.

The meeting will specifically cover the following aspects:

  • aspects relating to the execution phase of public contracts: subjective changes (insolvency proceedings, assignments) and objective changes (the "mandatory fifth", variations, and claims);
  • contractual non-performance and penalties;
  • an overview of the new EU directives on procurement (which will be transposed into the new, forthcoming public procurement code).
